Do you offer copyright releases?

We DO offer a limited print release with certain packages. More specific copyright information is listed below: Copyright Information: All images are copyrighted by Photo Family(PF) by Dwayne Gayle. It is illegal to copy or reproduce these photographs in any manner. Violations include, but are not limited to, making illegal copies, scanning, printing from home or at any other photo processing site, downloading from our website, using images as a screensaver for desktop background, uploading images to websites, putting images on photo products, making your own announcements/invitations, etc. Violators of this Federal Law will be subject to its civil and criminal penalties. As an Artist, Dwayne wishes to maintain complete control over the print quality, finishes, and presentation of the images and any reproduction outside of our studio may lower the quality of the image. Thank you for respecting our work and livelihood by choosing not to reproduce images. Photo Family by Dwayne Gayle reserves the right to use any image for display, publication, or other purposes. – Limited Copyright Release is Available with purchase of digital images. The images that are being provided to you are licensed to you for any reasonable personal purposes, including but not limited to: printing, copying, emailing, and web publishing. Your license does not include use that results in financial gain, including but not limited to: advertising, stock photography, print sale profits, or resale of any nature. Your purchase of the original files releases PF from any liability due to loss or damage of the images, and also releases PF from any obligation to maintain copies of any digital file, image, or photograph. You hereby grant to PF the right to use and publish images and photographs taken at your photography session to further promote its service, including portfolio, web site, display, advertisement, and editorial use. PF agrees to limit the use of these images and photographs to promotional use only. PF may revoke this license at any time and for any reason. PF retains all copyrights to the images and derivative works thereof. By using any of these images, you are agreeing to the above terms. PF retains the rights to all images and does NOT sell unedited images. Images purchased may not be edited or altered in any shape or form.

What does the Session Fee Cover?

Session Fee: The session fee pays for the photographer’s time and talent. It does not include any finished portraits, unless otherwise stated. (See Pricing Guide)

Do you offer on location sessions?

On Location sessions: Please be aware that outdoor sessions may need to be rescheduled in the event of inclement weather. If a permit is required to conduct a session in a client’s desired location, the client will be responsible for obtaining the permit and any costs involved. Locations outside a 25-mile radius of the studio are subject to a travel fee. Multiple locations will incur a fee of $25 per additional location (unless otherwise agreed)

What if my child is feeling sick?

Under the Weather: If your child is sick, please call to reschedule. Sick children do not like to be photographed and we know that you will not love your portraits nearly as much as if he or she was in good health. If you must cancel, please try to do so as soon as possible.

Is there a fee for rescheduling?

A $ 5 rescheduling fee will be applied to all appointments if a 24-hour notice is not given. This applies to sessions, ordering appointments, and order pickups. If you are a no call no show - a $20 fee will be required in advance prior to your next session booking.

When should I arrive for my session?

Arrival Time: Please arrive on time! It is to your advantage to be on time and ready to start the session. Starting late means you will have fewer images to choose from. Clients arriving more than 15 minutes late will be asked to reschedule, and the $ 5 rescheduling fee will be applied. If you are running late please be courteous and call ahead - based on availability we may not need to reschedule.

Can I bring people to the session?

Additional People at the Session: Please bring only the people to be photographed or in the case of children, parents are of course welcome. Please limit personal assistants, nannies, caregivers, other family members, or friends to one individual. Having additional persons present is very distracting for those being photographed. This is especially important with children sessions, as we need their full attention on the photographer rather than looking at what is going on around them. Also, please do not bring any pets to your session without prior approval. Thank you for your understanding in this matter. - Additional guests will be asked to stay in the lobby and view the session from there.

When will I see the images / proofs?

Viewing Your Images: Same Day Proofing: You will receive an email with a link to your gallery after the completion of your session. Your gallery will be active for 45 days. We must receive your order within the 45-day gallery activation period, or any print credit will be forfeited, no exceptions receive your order within the 45-day gallery activation period, or any print credit will be forfeited, no exceptions Effective 10/12/2020 - all previous sessions, weddings, events, MUST have their orders in no later than April 30, 2021 - if orders have not been received all print credit is deemed null and void.

Will I see all the images taken?

Photographic Rendering: While we do capture many images during your session, you will see only those images selected by the photographer for previewing. Each finished image is carefully rendered by the photographer to ensure maximum artistry and technical perfection. Images with eyes closed, heads turned, duplicates, etc. will not be shown and are removed from our archives permanently. All images are photographed in color, but are available in black and white or sepia for no additional charge.

Do you charge for editing?

Basic Touch Up: All final images include basic retouching, which include the removal of minor blemishes, small spots or scratches, small bruises, or single stray hairs. Anything beyond that is considered extensive retouching, and is subject to an additional artwork fee of $15/hour (minimum one hour). Extensive retouching can be discussed with Dwayne to determine your best options.

Do you offer albums / collages? Is there a charge?

Design Fees: A $25 design fee will be applied to graphic designs. You will be provided with a proof via e-mail for approval. Please review it carefully, as we are not responsible for errors such as the spelling of names, dates, and quotes after your approval has been made. Changes to designs can be made three times without incurring additional design fees.

Do you offer slide shows?

Custom slideshows can be created for the $25 design fee - music requirements for the slideshows is listed below. Slideshow Music Information: If you decide to purchase a slideshow, we will select and purchases individual music files from the internet on your behalf. The fee for the music file is automatically included in the cost of the slideshow. If you purchase a slideshow, and would like to bring in your own music to use, please provide a copy of the file – ensuring you have purchased this file – Photo Family will not be held liable for copyright laws regarding music files.

When will my prints be ready?

Portrait Delivery Time: after completion of session and payment has been processed, Prints will be available the same day. Canvases, collages, handbags, jewelry, and other specialty items allow up to 2-4 weeks. You will be notified when your order is ready for pickup.

Do you offer RUSH orders?

Rush Orders: Orders needed before the 2  -4 week time period will be considered “rush orders” and charged a $25 rush fee.

What forms of payment do you accept?

Payment: All portrait orders must be paid for in full at the time of ordering. Acceptable forms of payment include cash, check, credit card (Visa, Mastercard, American Express) . Please make checks payable to “Dwayne Gayle”. Returned checks are subject to a $25 non-sufficient funds fee and must be replaced with another form of payment. Payment plans are available for orders of $500 or greater – Digital Files will not be released until full payment has been received.

All Sales Final: Due to the custom nature of this work, all sales are final. No substitutions, exchanges or refunds are available after placing your order. Replacement will only be given in the case of damage caused by the studio.

Right of Refusal: All policies set forth by Photo Family by Dwayne Gayle have been implemented to provide all clients with the best possible service and the best possible price. The points outlined in this document are non-negotiable. If there are any policies with which you (the client) cannot comply, perhaps Photo Family by Dwayne Gayle is not the right photographer for you. Please treat us with the respect we deserve, and we will show you the same courtesy. If, for any reason, we do not feel able to provide you with the services you require, another photographer may be recommended. Photo Family by Dwayne Gayle reserves the right to refuse service to any client who knowingly and intentionally disregards any of the aforementioned policies. If you have any questions about these policies, please don’t hesitate to ask.

Do you offer re-shoots?

Satisfaction Guarantee: If you are not satisfied with your images, please notify us at the time of your viewing session. A re-shoot will be scheduled at no cost to you. Subjects must wear the same clothing and be photographed at the same location. If a re-shoot is desired, images from the first session will be deleted and no longer available for ordering. If you are displeased with the re-shoot, your session fee will be refunded with no obligation. All images will be purged after a session fee has been refunded.

Wiggly Kid Clause: Parents, it is your responsibility to keep your children under control during the session. If your child chooses to constantly act up and be disrespectful, we will have no other choice but to stop the session. If the session is stopped due to this reason, there will be no refunds! Also, please keep watch of your children around lighting, backdrops, etc. We appreciate the playful nature that children possess. However, playing with the equipment is not permitted due to safety and cost reasons. Thank you!

Can I Post To Social Media?

SOCIAL MEDIA Images may be used on Social Media, but Photo Family must be tagged in the photo. On Facebook, please add Photo Family as the copyright on each image posted. Downloading, printing, and/or editing the photos Photographer posts on Facebook is not allowed. Please do not crop the watermark/logo from the image. On Instagram, please do not use filters to change the appearance of the image and be sure to credit #PhotofamilyMD there as well.

Can I take photos during the session?

Exclusive Photographer: No camera, camcorder, or other recording device of any kind, other than the photographer’s, is permitted during the portrait session for both studio and location. This includes cell phone cameras.

Prices Are Subject To Change Without Notice: Prices are guaranteed for a period of 30 days following the date of the portrait session. Items purchased more than 30 days after the date of the session will be priced according to the most recent price guide.

Album Policy: Oftentimes we will show an image in both black and white, and color. When purchasing a session album, you will not receive both versions of an image; rather we will include whichever version is artistically more appealing.

Handling Your Portraits: Damage incurred as a result of improper handling, framing, or hanging is the responsibility of the client.
